1. Acceptance of Terms

By accessing or using the GROW AI Career Coach platform ("Service"), operated by Defynance Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

GROW is an AI-powered career coaching platform that provides resume optimization, job matching, interview preparation, LinkedIn profile optimization, and personalized career guidance. The Service uses artificial intelligence to generate recommendations and suggestions.

3. AI Disclaimer

AI-generated suggestions and recommendations are not professional advice. The Service provides AI-powered career coaching as a supplementary tool. It does not replace professional career counselors, recruiters, or legal advisors. You are solely responsible for decisions made based on the Service's output. We make no guarantees regarding employment outcomes, salary negotiations, or job placements.

4. Account Responsibilities

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to use the Service.
One account per person. Sharing accounts is not permitted.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or to solicit unlawful activity.
Attempt to reverse-engineer, decompile, or extract the AI models or proprietary algorithms.
Use automated tools (bots, scrapers) to access the Service beyond normal usage.
Upload false, misleading, or fraudulent information to your profile.
Circumvent rate limits, credit systems, or other usage controls.

6. Payment Terms

The Service offers free and paid tiers. Paid plans are billed on a recurring basis (monthly or annually).
AI credits are consumed per feature usage (e.g., resume optimization, job analysis). Credit balances and limits vary by plan.
Payments are processed through Stripe. By subscribing, you also agree to Stripe's terms of service.
Refunds are handled on a case-by-case basis. Contact support@defynancegrow.com for refund requests.
We reserve the right to change pricing with 30 days' notice to active subscribers.

7. Intellectual Property

All content, designs, and technology of the Service are owned by Defynance Inc. You retain ownership of the personal data and content you provide (resumes, profiles, etc.). By using the Service, you grant us a limited license to process your data for the purpose of providing the Service.

8. Data Usage

Your use of the Service is also governed by our Privacy Policy. We collect and process your data to provide career coaching, job matching, and analytics. We do not sell your personal data to third parties.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Defynance Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or employment opportunities, arising out of or related to your use of the Service.

Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time through the Settings page.
We may suspend or terminate your account for violation of these Terms, with or without notice.
Upon termination, your data will be deleted in accordance with our Privacy Policy. You may request a data export prior to deletion.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.
